PETALING JAYA (Nov 12): Residents of Main Place (pictured) at USJ21, Subang Jaya, are not happy at all with the Joint Management Body (JMB) and developer.

It is with this in mind that they have Main Place Residents Association Residents Association (RA) as they felt that they were not represented in the JMB.

“The developer holds 70% of the total share units in Main Place, and use their majority shareholder power to make decisions that favour them in the property’s annual general meeting (AGM),” Main Place RA pro tem secretary Kelvin Chong told The Star.

“The JMB comprises one representative of the developer while four others are unit owners that do not even live here,” he added.

Chong also claimed in the English daily’s report that the JMB had carried out several actions that went against the Strata Management Act 2013 (Act 757).

“Under the Act, the developer/JMB is supposed to hold an AGM every year and provide audited annual financial statements, including the maintenance fees and sinking funds.

“However, since Main Place was completed in April 2014, the first AGM was only held in August 2017 while the second was in August this year.

“About 300 residents turned up at this year’s AGM, but the developer’s main shareholder status allowed them to control the voting rights and make major decisions without considering the residents’ input,” he said.

Chong also said the residents did not have any info about the developer’s maintenance accounts until they asked the assistance of the Strata Management Tribunal.

“To our surprise, we found out that the developer and residents were paying different rates for the maintenance fees, when the Act states there should be only a single rate.

“The developer is paying RM2 per share unit while residents are paying RM3.35 per share unit,” he added.

“We are hoping to meet the developer’s holding company, as we are tired of dealing with the developer and property manager.

“We also hope the state and federal governments could look into our plight, as our case could set a precedent for other similar strata properties in Malaysia,” Chong appealed.
