KUALA LUMPUR (June 27): The High Court’s commercial division has fixed Jan 13, 14, 15, 17 and 20 as trial dates for the Malaysian government suit against National Feedlot Corp Sdn Bhd (NFC), its chairman Datuk Mohamad Salleh Ismail, his three children and six other related companies over the RM250 million loan.

Justice S Nantha Balan also ordered Salleh and the other defendants to file their defence on the suit by July 25.

theedgemarkets.com had previously reported that the suit was filed against Salleh, NFC, his children Wan Shahinur Izmir Mohamad Salleh, Wan Izzana Fatimah Zabedah Mohamad Salleh, Wan Shahinur Izran Mohamad Salleh and companies Meatworks Corp Sdn Bhd, Techknowlogy Imageware (M) Sdn Bhd, Real Food Company Sdn Bhd, National Meat & Livestock Corporation Sdn Bhd, Asian Bioscience Corporation Sdn Bhd and Agroscience Industries Sdn Bhd.

The claim against NFC and the Salleh family amounted to RM253.62 million — representing the sum owed to the government, together with interest of 2% per annum and default interest on RM224.77 million as at April 30, 2019.

This was related by senior federal counsels Mohd Radhi Abbas and Nurhafizza Azizan and affirmed by lawyer Chong Kah Yea when they met Justice Nantha Balan in his chambers.

Nurhafizza also told reporters that this court has fixed the trial to be held at the commercial division, rather than the High Court’s civl division.

Further case management has been fixed on Aug 22 and Dec 18.  

It was previously reported last month that Justice Nik Hasmat Nik Mohamed had ordered the transfer of the case from the civil division to the commercial division.

The government is also seeking a declaration from the court to have Salleh’s family personally liable for the debt repayment, the sum of RM118.04 million allegedly misappropriated from the loan and secret profits arising from it, as well as Putrajaya’s entitlement to claim equitable title to the properties bought using NFC’s RM250 million loan from the government.

Mohamad Salleh is reported to have issued a statement, saying a new buyer of NFC is willing to fully settle the loan and that Prime Minister Tun Dr Mahathir Mohamad has been informed accordingly via a letter dated Nov 21, 2018.
