JOHOR BAHRU (June 8): The Johor Bahru High Court on June 7, 2020 has struck out four suits against Country Garden Danga Bay Sdn Bhd (CGDB) filed by purchasers of its Danga Bay development, according to CGDB in a statement released last night.

The purchasers’ claims were made on the grounds of misrepresentation, alleging that the developer had delivered units that were different from the design agreed in their sale and purchase agreements.

"The High Court decided that the allegations disclosed no reasonable cause of action against the developer; that they were frivolous and vexatious; and/or an abuse of the court process," said the developer in the statement. The High Court dismissed the suits with cost to be paid to CGDB.

CGDB was represented by Leonard Yeoh and Eri Fu while the purchasers were represented by Viola Decruz and Vinobha Anthony Doss.

In another similar case, CGDB had filed an appeal to the Federal Court in December 2019 against the decision delivered by the Court of Appeal on Dec 11 regarding a dispute between a homebuyer and CGDB.

The Court of Appeal had dismissed an appeal filed by CGDB for a judicial review against a decision by the Homebuyers' Tribunal that favoured a Singaporean house buyer's claim that the developer had delivered a different unit. Ho Chee Kian, the purchaser was awarded RM15,000 in costs.
