Federal Court grants Country Garden leave to appeal against compensation

PETALING JAYA (July 6): Country Garden Danga Bay Sdn Bhd (CGDB) has obtained leave from the Federal Court to appeal against the decision of the Court of Appeal’s dismissal of its judicial review to quash the award given by the Johor Bahru Tribunal for Homebuyer Claims to a Singaporean house buyer.

In a press statement issued by CGDB today, its solicitors will submit requisite appeal documents to the Federal Court within 14 days, and the Federal Court will hear the appeal from CGDB against the Court of Appeal’s decision at a later date to be confirmed. 

“CGDB has always been a law-abiding corporate citizen, having the utmost respect of the laws in force in Malaysia. CGDB values all our purchasers and we want to work together towards a harmonized community,” said the company.

According to Bernama report, a three-member bench led by Court of Appeal president, Datuk Rohana Yusuf allowed the application brought by CGDB on four legal questions to be determined by the Federal Court in the appeal proper.

CGDB had sought leave to appeal against the appellate court’s Dec 11, 2019, decision of dismissing its appeal against the Johor Bahru High Court’s decision. 

CGDB was represented by Leonard Yeoh and Eri Fu while the purchasers were represented by Viola Decruz and Vinobha Anthony Doss.

To recap, The Johor Bahru High Court has struck out four suits against CGDB filed by purchasers of its Danga Bay development on June 7, 2020.

The purchasers’ claims were made on the grounds of misrepresentation, alleging that the developer had delivered units that were different from the design agreed in their sale and purchase agreements.
