KUALA LUMPUR (May 21): The judge assigned to hear the US$1.402 billion lawsuit filed by 1Malaysia Development Bhd (1MDB) against fugitive businessman Low Taek Jho (Jho Low), his father Tan Sri Larry Low Hock Peng, sister Low May Lin and accomplice Eric Tan Kim Loong has recused himself from hearing the case.

During case management of the suit today, Judicial Commissioner Quay Chew Soon decided that the case should be heard before another High Court judge because it was filed by Messrs Skrine, a legal firm where he served as a partner before being appointed a judicial commissioner.

Skrine's partner Siva Kumar Kanagasabai confirmed the outcome of the case management with The Edge.

The matter will be brought up for another case management before deputy registrar Nor Afidah Idris on June 10, checks with the court's filing system showed.

In the suit, 1MDB accuses Jho Low and the three others of being involved in fraudulent concealment, fraudulent misappropriation of funds, unjust enrichment, breach of trust and conspiracy.

A total of US$1.03 billion is sought from Jho Low, followed by another US$41 million from his associate Tan (US$41 million), US$328 million from his father and US$3.5 million from his sister.

Including this case, MDB filed six suits against Jho Low and the three others on May 7.

One of the suits involving 1MDB and its former subsidiary SRC International Sdn Bhd has been assigned to Judicial Commissioner Liza Chan Sow Keng.

Jho Low is said to be the mastermind of the 1MDB scandal and action has been brought against him in various jurisdictions, including in the US, for forfeiture.
