KUALA LUMPUR (July 26): The Yang di-Pertuan Agong should be the one who revokes and announces the decision on the proclamation of Emergency Ordinance, Parti Warisan Sabah president Datuk Seri Mohd Shafie Apdal said.

In his parliamentary speech today, the member of Parliament (MP) for Semporna referred to the government's decision earlier today to revoke all Emergency Ordinances that were promulgated during this Proclamation of Emergency early this year.

"Whose rights to revoke ordinance? Yang di-Pertuan Agong was the one who proclaimed the Ordinance and he should be the one who tells the world and country that the revocation is done.

"And if the Emergency Ordinances have been revoked, why include them in today's agenda?" he asked.

Earlier, de facto Law Minister Datuk Seri Takiyuddin Hassan announced that the government had decided not to advise the King to extend the proclamation of Emergency beyond Aug 1.

In a surprising twist of events, Takiyuddin also revealed that the government had decided, based on Article 150(3) of the Malaysian Constitution, to revoke all Emergency Ordinances that were promulgated during this Proclamation of Emergency early this year.

He said the decision to revoke all six Emergency Ordinances was achieved during a Cabinet meeting on July 21.

According to Article 150(3) of the Malaysian Constitution, a proclamation of Emergency and any ordinance promulgated during the period shall be laid before both houses of Parliament and, if not sooner revoked, shall cease to have effect if resolutions are passed by both houses annulling such proclamation or ordinance.

Meanwhile, Shafie said that Parliament should be the checks-and-balances platform to the government and not only merely voice opinions.

"Our government has spent more than RM800 billion or almost RM1 trillion, including moratoriums, EPF (Employees Provident Fund) withdrawals. This is worrying (when) other countries such as Vietnam, Pakistan and Thailand haven't spent as much as our country and their Covid-19 situations are not as bad as ours," he added.

The special five-day Dewan Rakyat sitting commenced today.

The Prime Minister's Office on July 5 said the Special Sitting was intended to provide explanations to MPs about the National Recovery Plan and to amend all the necessary laws and rules to enable hybrid Parliament sittings, and for the proclamations of emergency and Emergency Ordinances to be laid before Parliament.
