PUTRAJAYA (July 19): The prosecution has appealed to the Federal Court against the acquittal of former federal territories minister Datuk Seri Tengku Adnan Tengku Mansor in his RM2 million graft case.

A source from the Attorney-General’s Chambers confirmed that the notice of appeal was filed today.

"Yes the notice was filed at 12.30pm today. The case will be appealed to the Federal Court," the source told The Edge on condition of anonymity.

In a two-one majority decision, Tengku Adnan, 70, also known as Ku Nan, was acquitted by the Court of Appeal last Friday.

Justices Datuk Suraya Othman and Datuk Wira Ahmad Nasfy Yasin found the Umno lawmaker guilty, while Justice Datuk Abu Bakar Jais maintained the High Court's guilty verdict.

Tengku Adnan was charged with accepting RM2 million from Aset Kayamas Sdn Bhd managing director Tan Sri Chai Kin Kong sometime in June 2016 via a cheque deposited into Tadmansori Holdings Sdn Bhd, a company the former minister owns.

The majority bench accepted the former minister's defence that the funds were deposited for the Kuala Kangsar and Sungai Besar parliamentary by-elections.

However, Justice Abu Bakar ruled that the element of corruption had been proven as he questioned the motive of the transfer of funds from Aset Kayamas into Tadmansori for no valuable consideration.

High Court Justice Mohamed Zaini Mazlan earlier found the former minister guilty and sentenced him to 12 months’ jail and a RM2 million fine under Section 165 of the Penal Code.
