Mulpha named in Australian class action over Mulgoa Rise project

PETALING JAYA (June 23): Mulpha International Bhd’s indirect wholly-owned subsidiary, Mulpha Norwest Pty Ltd, has been served with an amended statement of claim in an Australian class action linked to its Mulgoa Rise residential project in New South Wales, it said in a Bursa filing yesterday.

The claim, filed in the Federal Court of Australia and amended on June 5, is brought by Raymond Joseph William King on his own behalf and on behalf of other current and former landowners in the Mulgoa Rise area. King is a tenant-in-common owner of a residential property at 30 Shale Hill Drive, Glenmore Park, within the Mulgoa Rise precinct.

Mulpha Norwest, named as the first respondent, was the developer of the Mulgoa Rise residential project, while Penrith City Council, the approving authority for the development and subdivision of the land, is named as the second respondent. The subsidiary is not classified as a major subsidiary of Mulpha International for reporting purposes.

The applicant alleges that parts of the land in Mulgoa Rise were not suitable for residential construction using a “deemed to comply” slab design, or for houses other than those built on slabs with piles extending to natural ground or bedrock. The claim seeks compensation for alleged loss and damage arising from repair, demolition, rebuilding and land remediation costs, as well as negative impacts on property values, and is framed in negligence and misleading or deceptive conduct. 

No specific quantum of damages has been stated at this stage.

Mulpha said the proceedings are set for hearing from May 3, 2027. It added that, if the applicant succeeds in his claim against Mulpha Norwest, the potential damages, losses and costs arising from the claim may be material, although the group does not expect any operational impact on its businesses.

The company and Mulpha Norwest “categorically deny” the allegations of wrongdoing and intend to defend the claim vigorously through the legal process, adding that further announcements will be made when there are material developments.
