Court of Appeal rules against Compugates in Dengkil JV dispute

PETALING JAYA (July 29): Compugates Holdings Bhd's long-running legal dispute with its joint venture (JV) partner over a proposed mixed-use development in Dengkil, Selangor, has moved further in favour of Main Uptown Sdn Bhd after the Court of Appeal dismissed an appeal by Compugates Development and Mining Sdn Bhd (CDMSB) while allowing Main Uptown's cross-appeal.

The Court of Appeal delivered its decisions on July 6, with the court orders and certificates of allocatur received by Compugates on July 27, the company said in a Bursa Malaysia filing on Tuesday (July 28).

The dispute stems from a joint venture between CDMSB, a 70%-owned indirect subsidiary of Compugates, and Main Uptown to develop a 154,990 sq m leasehold parcel in Mukim Dengkil, Sepang, into a mixed-use development.

Under Civil Appeal No. B-02(IM)(NCvC)-499-04/2025, filed by CDMSB against Main Uptown, the Court of Appeal dismissed CDMSB's appeal and ordered it to pay RM20,000 in costs, subject to the allocatur fee.

In the related Civil Appeal No. B-02(IM)(NCvC)-509-04/2025, brought by Main Uptown against CDMSB, the appellate court allowed Main Uptown's appeal and ordered CDMSB to pay a further RM20,000 in costs, also subject to the allocatur fee.

The appeals arose from Originating Summons No. BA-24NCVC-1150-07/2022 in the High Court and form part of a dispute that has generated multiple Bursa announcements since 2015.

Compugates said it would make further announcements should there be any material developments.
