Compugates’ Federal Court leave bid over Dengkil JV set for Dec 10

PETALING JAYA (Sept 4): Compugates Holdings Bhd’s application for leave to appeal to the Federal Court in a dispute involving a proposed mixed development in Dengkil, Selangor, has been fixed for hearing on Dec 10.

In a Bursa Malaysia filing on Friday (Sept 4), Compugates said the Federal Court had directed the parties to file their written submissions by Nov 18, with the next case management fixed for Nov 19.

The hearing is scheduled for 9am at the Federal Court in Putrajaya.

Compugates Development and Mining Sdn Bhd (CDMSB), a 70%-owned sub-subsidiary of Compugates, is the applicant, while Main Uptown Sdn Bhd is the respondent. CDMSB filed the leave application on July 21.

The dispute relates to a joint venture to develop a 154,990 sq m, or about 38.30-acre, leasehold parcel in Mukim Dengkil, Sepang, Selangor, into a mixed development.

The land is identified as H.S. (D) 13828, PT 26800 (New Lot No: 30729).

Court of Appeal rulings

The leave application follows Court of Appeal orders made on July 6 in two related appeals arising from High Court proceedings.

In one appeal, the Court of Appeal dismissed CDMSB’s appeal and ordered it to pay Main Uptown RM20,000 in costs, subject to allocatur.

In the other, the court allowed Main Uptown’s appeal against CDMSB and similarly ordered CDMSB to pay RM20,000 in costs, subject to allocatur.

Compugates’ financial statements state that the appeals arose from the High Court’s assessment of damages suffered by CDMSB during the relevant period of an interlocutory injunction obtained by Main Uptown.

In February 2025, the High Court assessed CDMSB’s damages for the relevant injunction period at RM750,584, with Main Uptown ordered to pay RM5,000 in costs, subject to allocatur.

Main Uptown paid the damages and costs on April 24, 2025, according to Compugates’ financial statements.

Compugates said it will make further announcements on material developments.
