The former prime minister's lawyer Harvinderjit Singh said there are other circumstances that the court ought to consider, like whether Najib originally — at the material time — knew that the money that went into his accounts came from SRC, formerly a subsidiary of 1Malaysia Development Bhd.
The 1MDB or Tanore trial is scheduled to begin on Aug 19 next month.
He signed a directors’ circular resolution ratifying Ihsan Perdana Sdn Bhd as the CSR partner of the company while he was hiding in Bangkok, Thailand.
"This is not a question of the court obstructing the accused from attending parliament [as] he is not prevented from attending [Parliament] whenever court is not in session," Justice Nazlan said.
Mazidah, 70, who is the prosecution's 40th witness, said when the paper on SRC was presented to the Cabinet sometime in 2011 or 2012, it was immediately passed and there was no deliberation.
"I expressed being uncomfortable preparing the memo but it fell on deaf ears. I had previously complained to Maliami on other previous occasion but no action had been taken."
Usually, the ministry would not need to seek information from the company applying for the loan.
Witness Afidah Azwa Abdul Aziz (pictured), who is the deputy secretary at the Ministry of Finance's strategic investment division, also told the court that SRC was seen defaulting its loan payments in 2015, 2016 and 2017, and it had to obtain a loan from the government to prevent an event of default.
