The process to amend an act is time consuming as the authorities are required to conduct public engagements to gather supporting data and evidence before getting approval from the Attorney General to table the amendment in Parliament.
Why would an amendment to the SMA take a long time?
The recent decision by the Court of Appeal on a flat rate maintenance fee has stoked debate among stakeholders, some for and some against.
Industry stakeholders who made up the panel included the president of the Building Association of Malaysia (BMAM) Tan Sri Teo Chiang Kok, president of the Real Estate & Housing Developers’ Association (Rehda) Malaysia Datuk Soam Heng Choon, president of the Malaysian Institute of Property & Facility Managers (MIPFM) Adzman Shah Mohd Ariffin and founder and managing partner of Chur Associates, Chris Tan.
“Strata titles are issued by the respective state’s PTG (Land and Mines Office). So, if the state government (is slow) and the e-Tanah (the electronic land administration system) doesn’t work in that state, nothing will come out.”
“I think the approach to revamp the Act is necessary but we must not just regulate and kill the creativity of the developers, especially when times are bad now and creativity is badly needed,” said the MD of JKG Land, who was one of the participants of the Fireside Chat.
