Justice Mohamed Zaini Mazlan in his decision today said after perusing the amended Section 41A of the Malaysian Anti-Corruption Commission (MACC) Act, he arrived at a decision to admit the recording and its transcript.
Justice Datuk Seri Mariana Yahya decided to allow the applications by the group, ruling that it is a public interest and constitutional issue.
Datuk Jagjit Singh, who leads her legal team, said she is emotionally upset and distressed with the decision.
They argued that the application is frivolous, vexatious and an abuse of the court process.
Justice Mohamed Zaini Mazlan ruled the prosecution had proven a prima facie case against Datuk Seri Najib Razak's wife.
“Justice Mariana's decision was to postpone the hearing of the said application to another date, pending the hearing of the application for leave which has been fixed for March 4,” said Anwar's counsel Ramkarpal Singh.
Justice Anselm ruled that there is no public law element involved in the state's decision.
The firm said the impugned post contained an untrue, unwarranted, unsubstantiated and mischievous statement on Muhyiddin.
The date has been fixed following case management on Feb 8.
