The decision was delivered in the case of Spatial Design Architects Sdn Bhd v Majlis Perbandaran Klang & Ors [2024] MLJU 3982, where the court found that any condition reserving submission rights exclusively for Registered Town Planners contravenes the Town and Country Planning Act 1976.

Speaking on behalf of Semantan Estate (1052) Sdn Bhd during court proceedings on Thursday, senior counsel Datuk Dr Cyrus Das said the court must decide whether it can "regularise" an acquisition irregularity that has been declared illegal by the High Court, Court of Appeal (COA) and the Federal Court.

"This initiative underscores the state government's commitment to providing opportunities for those without land to secure property of their own," said chief minister Datuk Seri Ab Rauf Yusoh.

"The contents of the letter do not refer to the respondent as the party responsible for finding replacement land," the court said.

In his 66-page ruling released Tuesday (July 22), Justice Datuk Lee Swee Seng stated the decision favoring the government was straightforward, citing the broader need to shield public entities from litigation that could impede governance.

Judge Datuk Lee Swee Seng, who led the three-member bench, fixed Nov 7 as the hearing date for both appeals, as both parties agreed that it would proceed without grounds to High Court judge Datuk Ahmad Shahrir Mohd Salleh’s decision on Aug 7, which contains the order for the registration of the transfer.

The appeal was scheduled to be heard before a three-member Court of Appeal bench led by Datuk P Ravinthran, but following the discontinuance of the appeal, it was struck out.

The officer confirmed that there was no written application for the loan, and hence there was no rejection of the loan.
