8 Conlay developer appealing GDB’s recovery of RM103 mil in unpaid sums

KUALA LUMPUR (Feb 13): GDB Holdings Bhd (KL:GDB) said its wholly-owned subsidiary Grand Dynamic Builders Sdn Bhd has obtained a favourable High Court judgment against KSK Land Sdn Bhd, which is in liquidation, to recover amounts owed for works on the 8 Conlay project.
“As a result of the above decision, the adjudication decision has been enforced by virtue of Section 28 of the Construction Industry Payment and Adjudication Act 2012 as if it is a judgement or order of the High Court.
The sum comprises RM76.
This was, however, just a little over half of the RM102.
“The much-considered decision to appoint CCSB as 8 Conlay’s new main contractor was made looking towards the future, and at our commitment to complete the project in the shortest time possible without compromising on quality,” said Joanne Kua, CEO of KSK Group and managing director of KSK Land.
The arbitration notice was filed in response to GDBSB’s notice of demand amounting to RM102.
According to a press statement, the contract between DCSB and GDBSB was terminated due to a failure to achieve agreeable solutions to various disputes relating to construction site matters over a period of the last nine months.
GDB said it would resume façade work on Tower A, and that full work on the project will resume in early April 2023, provided Damai City meets the agreed terms and settles the outstanding amounts as scheduled.
