SUBANG JAYA (Nov 16): The developer of Main Place @ USJ21, Subang Jaya has said that its actions with the Joint Management Body (JMB) were “done as provided under the Strata Management Act 2013 and the original Sales and Purchase agreement (S&P)”, The Star daily reported yesterday.

“We came in as a white knight to revive and complete the project when it was abandoned more than 15 years ago.

“We had to honour the original S&P signed between buyers the original developer, and did not add anything new to it,”  Jason Yam, the managing director for the developer Sumbangan Lagenda Sdn Bhd, explained to the English daily in a report.

Yam also said that there was a delay in forming the JMB due to “complications with the Tenaga Nasional Bhd (TNB) billing issue and location of cooling tower for the mall”.

Touching on the issue of the composition of the JMB, he said that “as owners of the mall, with 4½ times’ stake more than the residents, we have a major interest in it and want to ensure the JMB is under the developer so we can take good care of the property”.

He also added that Main Place’s retail segment has recorded an occupancy of more than over 93%.

As for the annual general meeting, “when the Commissioner of Buildings (COB) at Subang Jaya Municipal Council (MPSJ) advised them to hold the AGM, it was held in 2017”, said Yam.

He also said the different service charge rates the some residents were complaining about was allowed under Section 60 of the Act.

“If we did not have different rates, residents would have to pay more to match the developer’s rates to cover the mall’s amenities and maintenance such as air-conditioning and escalator.

“The Act’s 2017 amendment required the service charge to be calculated based on share units rather than square footage. If the residents calculate the conversion from square footage to share allocation, the total sum to pay remains the same at RM3.35 per share,” Yam explained further, said the report.

Yam was speaking in response to issues raised by the Main Place Residents Association pro-tem committee last week.
