佳居锦囊:HDA法令下的购屋者权益保障

购屋者,在你付了头期、签下房屋买卖及房贷合约后,你可知道你应有的权益吗? 只要你购买的是“住宅房产”,你就会受到1966年房屋发展(管制与执照)法令(HDA)保护,但也就是说,若你购买的是商业房产,你就不受此法令保障。   HDA下的保障一:隔绝误导性广告 发展商所刊登的广告,往往就是购屋者所接触的第一手资讯。 虽然一些购屋者擅长在网络或社交网站平台做功课,了解发展商所提供的资讯真伪,但依然有部分购屋者对广告资讯深信不疑,所以具误导成分的广告资讯,将影响他们的购屋决定。 因此,在HDA法令规范下,发展商必须确定广告资讯如实,同时也禁止提到以下具误导性的资讯: - 是否提供律师费; - 是否给予金钱回扣或是租金收益; - 相关发展项目提供的景观; - 相关发展项目与临近设施或热门景点的车程时间;   HDA下的保障二:法定终止买卖合约 若发展商已超过半年没有继续建设工程,那购屋者该怎么办? 在2012年HDA法令修订后,只要房产建筑管理人在书面证明,工程已停滞超过6个月,并且也已取得贷款银行的允许,购屋者便可向发展商提出终止买卖合约的要求。 接获终止买卖合约要求后,发展商必须在30天内,无利息偿还购屋者已付款项。违约发展商将被罚款最低RM5万,最高RM25万。   HDA下的保障三:分层地契 在Schedule H法令修订后,分层地契现已是房屋完工移交程序的一部分。发展商必须在房屋移交前,就先申请分层地契。 不过,这也意味着,购屋者在拿到房子的钥匙时,也须同时缴付分层地契的印花税。   Chris Tan为TheEdgeProperty.

Developers can now withdraw 80% of deposit after CCC issued

KUALA LUMPUR (Nov 29): Developers will be able to be able to retrieve 80% of the 3% developer's deposit after the Certification of Completion (CCC) is obtained while the remaining 20% will be returned after the defects and liability period effective from Nov 11, said Minister of Urban Wellbeing, Housing and Local Government, Tan Sri Noh Omar (pictured) at the Real Estate and Housing Developers’ Association (Rehda) annual dinner tonight.
