购屋者,在你付了头期、签下房屋买卖及房贷合约后,你可知道你应有的权益吗? 只要你购买的是“住宅房产”,你就会受到1966年房屋发展(管制与执照)法令(HDA)保护,但也就是说,若你购买的是商业房产,你就不受此法令保障。 HDA下的保障一:隔绝误导性广告 发展商所刊登的广告,往往就是购屋者所接触的第一手资讯。 虽然一些购屋者擅长在网络或社交网站平台做功课,了解发展商所提供的资讯真伪,但依然有部分购屋者对广告资讯深信不疑,所以具误导成分的广告资讯,将影响他们的购屋决定。 因此,在HDA法令规范下,发展商必须确定广告资讯如实,同时也禁止提到以下具误导性的资讯: - 是否提供律师费; - 是否给予金钱回扣或是租金收益; - 相关发展项目提供的景观; - 相关发展项目与临近设施或热门景点的车程时间; HDA下的保障二:法定终止买卖合约 若发展商已超过半年没有继续建设工程,那购屋者该怎么办? 在2012年HDA法令修订后,只要房产建筑管理人在书面证明,工程已停滞超过6个月,并且也已取得贷款银行的允许,购屋者便可向发展商提出终止买卖合约的要求。 接获终止买卖合约要求后,发展商必须在30天内,无利息偿还购屋者已付款项。违约发展商将被罚款最低RM5万,最高RM25万。 HDA下的保障三:分层地契 在Schedule H法令修订后,分层地契现已是房屋完工移交程序的一部分。发展商必须在房屋移交前,就先申请分层地契。 不过,这也意味着,购屋者在拿到房子的钥匙时,也须同时缴付分层地契的印花税。 Chris Tan为TheEdgeProperty.
