问：管理机构（MC）或联合管理机构（JMB）需要设立公司来管理资金吗？谁要为资金管理负最大责任？ 根据2013年分层管理法令，MC和JMB的功能是妥当维护和管理建筑物、土地和公共空间。 在该法令中，没有任何一个条规允许MC 或JMB设立公司来管理资金。不过，MC或JMB可成立小型资金管理委员会，由通过投票挑选出来的会员们，对资金进行有效的管理。 问：我们打算利用公寓内的公共礼堂来开办托儿所。请问MC需要向有关部门提出申请吗？ 根据2015年分层管理（维护和管理）条例第3附表的第3（4）条，MC或JMB应该“在恰当的情况下，管理、维护和采用合适的营运商，来管理任何公共财产中的公共设施、便利设施和服务，如自动洗衣店、便利店、餐厅、托儿所和其他”。 不过，他们“必须维持合理的安全和健康标准，从而为经营者和使用者带来使用上的便利、舒适和愉悦”。 假设该公共礼堂是公共财产的一部分，我们认为，根据上述第3（4）分段条例，必须获得相关单位的批准，JMB或MC才可以有权利将该礼堂转为托儿所，并寻找合适且有利所有业主的经营者来开设托儿所。 Chis Tan是Chur Associates的创办人兼管理合伙人。他也是2019年EdgeProp 大马优质产业管理大奖（EdgeProp Malaysia’s Best Managed Property Awards 2019）的评委，以及EdgeProp.
