问:一些住户想要把他们的单位以短租的方式出租,物业管理单位可以阻止他们吗? 答:2015年分层管理(维护和管理)法令第三附录中,并没有明文指出短租是不被允许的。不过,根据2013年分层管理法令的第70(2)条,管理机构(MC)可以通过常年会议,让居民表决是否接受短租。若接受,这将成为该住宅大楼的附加细则,以规范细分建筑物或土地和公共财产的控制、管理、使用和享用。这些附加条例对管理层、业主、租户和占用者具有约束力。 有鉴于此,管理机构可召集临时大会通过特别决议,禁止业主进行任何短租活动,并可进一步通过决议,对违反该规定的任何业主征收每日最高RM200的罚款。 通过制定这两项附加条例,管理机构可阻止业主进行短租活动,并对违规者征收每日RM200的罚款。   问:我们的公寓有两栋住宅大楼。其中一栋是政府可负担房屋计划下的Rumahwip,而另一栋则是在开放市场销售的较大与高级的单位。管理机构是否应该向两栋大楼的居民征收同样的管理费呢? 管理费、储备金和其他维护和管理公共空间财产的费用,是根据份额单位(share unit)来计算的。 根据2013年分层管理法令的第一条,份额单位是根据好几个原因,包括每户单位的大小而定的。 既然另一栋大楼的单位面积较大,所以很自然地份额单位也会比可负担房屋大楼来得高。换句话说,可负担建筑所贡献的管理费,会比另一栋大楼少。   Chris Tan是Chur Associates的创办人兼管理合伙人。他也是2019年EdgeProp 大马优质产业管理大奖(EdgeProp Malaysia’s Best Managed Property Awards 2019)的评委,以及EdgeProp.
