Nancy与一些居民最近受委担任公寓共管机构(Joint Management Body,简称JMB)共管机构委员会(joint management committee ,简称JMC)成员,这也是他们第一次担此重任,对于新的身份也感到兴奋与忐忑。 最让他们感到紧张的是,他们对于《分层管理法令》(Strata Management Act 2013,简称SMA)并不熟悉,在近期的HBA与公众的分享会中,HBA志工们向Nancy讲解JMB的职务,以及需要注意的事项,在此以问答方式整理出来,希望借此让许多JMB新手成员都能受惠。 问:我们上一次的年度大会是在今年6月,那下一个年度大会(AGM)应该在何时举行?应该讨论什么事项? 答:年度大会应每年举办一次,且距离上一个会议不应超过15个月,那也就是说,Nancy的JMB应在2020年8月31日之前举行。 不过,即便过了15个月的期限,会议达致共识的议案,也一样具有法律效益。 一般上,在年度大会必须寻求通过的事项包括已审核账目通过、联合管理委员会成员委任,以及和管理与维修相关的事务。 问:如果我们过了限期依然没有举办年度大会,有何后果? 答:在SMA下,一旦委员会未能在期限内举办年度大会,视同违法,一旦罪成,将被罚款不超过RM50,000或监禁不超过三年,除非他们能提出证据证明自己已经尽己所能履行职务。 如果联合管理委员会对于举办年度大会的事务推拒或是怠慢,且错过15个月的期限,居民可以向地方市议会的建筑物委员会(Commissioner of Buildings,简称COB)投诉。 问:在年度大会举办之前,我们需要做什么? 答:联合管理委员会需要在年度大会举办的至少14天前,通知单位业主,通知方式包括将文件亲手交托,以挂号信方式邮寄或在公共空间的显眼处张贴开会通知。 开会通知必须清楚列明开会的日期、时间与地点,在年度大会中将会讨论的事项,每一个单位业主的投票权或代理投票权。 开会通知也需要附上上一次年度大会的会议记录、已审核账单、审计师的审查报告以及其他会议相关的事项资料。 问:年度大会的法定人数? 答:年度大会的法定人数为有投票权人数的一半,出席者可以是业主本身或代理人。不过,法定人数一般很难达到。因此,SMA采纳较具弹性的方式避免浪费开销与时间。如果在召开年度大会后的半小时内,出席者没有达到法定人数,则有权投票的出席者人数将被视为法定人数,年度大会可以继续进行。 问:年度大会由谁主持? 答:每一个年度大会都将由大会主席主持,主席人选将从出席会议且拥有投票权的业主当中选出,获选的大会主席,将主持会员会至结束。联合管理委员会主席不能兼任年度大会主席。 Datuk Chang Kim Loong是国家房屋买家协会(HBA)的荣誉总秘书。 HBA的联络方式: 电邮:info@hba.
PETALING JAYA (Oct 24): The Court of Appeal’s ruling to disallow Joint Management Bodies (JMBs) to charge different rates of service fees for different components within mixed-use developments is based on a strict interpretation of the Strata Management Act 2013 (SMA) and the Strata Management (Maintenance and Management) Regulations 2015, said Building Management Association of Malaysia (BMAM) and the Malaysia Shopping Malls Association (PPK).
